Why You Should Invoke Your Right to Remain Silent

Being charged with a crime is one of the most stressful, even humiliating, things that any individual can experience. You feel scared and confused. When first accused of a crime, a police officer is not required to be honest with the person being accused. People naturally assume that the police will treat them fairly, answering their questions honestly and not intentionally misleading them. As a result, people are often shocked to find-out that not only are police allowed to lie, but they often do this to get people to confess to crimes. "If you tell me the truth, I'll release you." Or, "If you admit that you're the person who stole the money, I'll make sure the District Attorney gives you probation." In fact, police can say whatever they want if they think it will help them make an arrest.

I sometimes get calls from people who claim that the police are telling them that they just want to talk and have no intention of arresting them. Then as soon as they finish speaking with the officer, the cuffs go on and the person goes to jail. Fortunately, we have rights, especially the right to remain silent and to have the assistance of an attorney when we're being charged with a crime. Every time I receive a call about a potential arrest, I immediately tell the person calling that they have the right to speak to an attorney, and they should remain silent until the attorney is present.
